Mediation/Neutral

Mediation usually involves two parties. However there are instances such as differences between multiple employees and a manager, that go to mediation.

Every Alternative Dispute Resolution (ADR) requires willing participants. When one or more parties contacts us, we quickly ascertain whether Exceptional Resolutions can help them most effectively by providing negotiation, mediation or arbitration. A vast majority of our work fits best in mediation.

Regardless of which service is required, we begin by requesting as much relevant information as possible. Depending on the subject, that could range from tax returns to personnel records. After reviewing everything a client provides, we create an inventory. If more information is needed, we request it at that time.

We set up individual meetings with all participants. We will try for a group meeting. Some participants in ADR prefer not to attend in-person meetings. If the other party or parties agree, they will not meet. Increasingly, parties to ADR choose to meet electronically for convenience.

Once consensus has been reached, participants agree to all the necessary points that originally separated them. If a court filing is required, as in the case of divorce, Exceptional Resolutions will prepare the necessary documents.

Arbitration

The arbitration process brings parties in a conflict together, similar to mediation. We begin by asking the participants to present us with a summary of the issues. Unlike mediation, the parties involved present arguments that support their positions. Unlike the mediator, the arbitrator reaches a conclusion and offers an opinion about how best to resolve the conflict.

Parties to an arbitration can agree to be bound by the arbitrator’s decision or they can choose not to take any action the arbitrator suggests. Arbitration is a less costly alternative to a trial before a judge with the same advantages of having an impartial person provide a judgement on the ussues.

Negotiaiton

Exceptional Resolutions will facilitate orderly, fair and impartial negotiations on any issue or issues. We gather information and listen to opinions similar to arbitration and mediation. However, the facilitator in negotiation takes an active role in helping the parties reach consensus.  While we don’t impose a decision on participants, our goal is bridging the gaps between parties.  

Neutral Factfinding

This process begins the way other alternative dispute resolution processes begin, by gathering information. The goal is to provide an unbiased evaluation of the issues.
