Alternative Dispute Resolution requires two (or more) willing parties. Sometimes one party starts out more willing than the other(s).
We offer a unique service to help encourage the less willing party to participate in ADR. The other party could be someone with whom you have a personal relationship, a boss or manager, a vendor or a contractor., literally, anyone with whom you find yourself in conflict.
Exceptional Resolutions will send a printed letter by mail to the other party explaining your desire to settle the conflict or conflicts between you using ADR. We will refer to the letter content as a complaint. See the letter content below:
Dear [X:]
This letter will inform you of [your name’s] request for you to engage in Alternative Dispute Resolution (ADR) to resolve [your issue].
Exceptional Resolutions (www.exceptionalresolutions.com) is not an arm of the court, the state or any entity connected to the legal system. We are an independent organization that facilitates Alternative Dispute Resolution using methods such as mediation, arbitration and negotiation. Our facilitators are unbiased. They do not and cannot take sides or advocate for either party. We simply help parties to the ADR find a way to consensus.
People choose Exceptional Resolutions and ADR for a number of reasons, chief among them to avoid the expense, time delays and stress that come with using the courts to settle disputes. Parties to ADR don’t need their own lawyers. The facilitator represents the interests of all parties, equally.
You are under no obligation to agree to this request for ADR. Exceptional Resolutions will not escalate this request for ADR nor will we threaten any future legal action.
I encourage you to reply to this message and begin dialogue with me to explore the possibility to bring this matter to a harmonious conclusion.
